" Part 6—Periodic inquiries by the Productivity Commission
18 Simplified outline of this Part
The Productivity Commission is to conduct periodic inquiries of the impacts of Australia’s nationally determined contribution on rural and regional Australia.
19 Productivity Commission inquiries
(1) During the period starting at the commencement of this Act, and ending on 30 June 2025, the Productivity Minister must, under paragraph 6(1)(a) of the Productivity Commission Act 1998 , refer to the Productivity Commission for inquiry the matter referred to in subsection (3).
(2) During:
(a) the period of 5 years starting on 1 July 2025; and
(b) each subsequent 5-year period;
the Productivity Minister must, under paragraph 6(1)(a) of the Productivity Commission Act 1998 , refer to the Productivity Commission for inquiry the matter referred to in subsection (3).
(3) For the purposes of subsections (1) and (2), the matter is the impacts of Australia’s nationally determined contribution on rural and regional Australia, including:
(a) the economic impacts of the Commonwealth’s climate change policies on rural and regional Australian communities and industries; and
(b) the social impacts of the Commonwealth’s climate change policies on rural and regional Australian communities and industries; and
(c) trends in reductions in Australia’s greenhouse gas emissions; and
(d) any adjustments required to the Commonwealth’s climate change policies or to the greenhouse gas emissions reduction targets included in Australia’s nationally determined contribution (including to the timeframes for the relevant targets).
Reports on inquiries etc.
(4) In referring the matter to the Productivity Commission for inquiry, the Productivity Minister must:
(a) under paragraph 11(1)(b) of the Productivity Commission Act 1998 , specify the period referred to in subsection (1) or (2) in which the referral occurs as the period within which the Productivity Commission must submit its report on the inquiry to the Productivity Minister; and
(b) under paragraph 11(1)(d) of that Act, require the Productivity Commission to make recommendations in relation to the matter referred to in subsection (3).
Note: Under section 12 of the Productivity Commission Act 1998 , the Productivity Minister must cause a copy of the Productivity Commission’s report to be tabled in each House of the Parliament.
(5) The Productivity Minister must not withdraw the reference before the Productivity Minister has received the report.
Consideration of report
(6) As soon as practicable after the Productivity Commission submits its report to the Productivity Minister, the Productivity Commission must give a copy of the report to the Minister administering this Act.
(7) If the Minister administering this Act is considering either of the following matters, the Minister must have regard to any relevant recommendations made by the Productivity Commission:
(a) the greenhouse gas emissions reduction targets that should be included in a new nationally determined contribution to be communicated by Australia in accordance with Article 4 of the Paris Agreement;
(b) the greenhouse gas emission reduction targets that should be included in Australia’s nationally determined contribution as the result of an adjustment to be made in accordance with paragraph 11 of Article 4 of the Paris Agreement.
Matters relating to industry, industry development and productivity
(8) For the purposes of paragraph 6(1)(a) of the Productivity Commission Act 1998 , the matter referred to in subsection (3) is taken to be a matter relating to industry, industry development and productivity.
Definitions
(9) In this section:
Productivity Minister means the Minister administering the Productivity Commission Act 1998."
